Immigration Fees

We at Equity Law Chambers are committed in ensuring that our clients obtain access to justice at affordable legal costs.

For a range of services, we offer agreed fee services. In most cases we can offer a fixed fee option. This is usually an agreed fixed legal fee, which you will have to pay us at a certain stage in your case. Depending on the complexity of the case, each stage of your case may attract a further cost.

The information that has been provided below is based upon an estimation as every individual case will depend on your personal circumstances. Please note that all work is undertaken on a private basis and subject to case circumstances.

Pricing

  • Initial immigration consultation will be free for the first half an hour, any time spent above this will be charged at a fixed fee of £50.00 plus VAT (at the applicable rate) for every further half an hour.
  • Document check service: Fixed fee of £150.00 plus VAT (at the applicable rate).
  • The current applicable rate of VAT is at 20 percent

Immigration Appeals

Disbursements are costs related to your matter that are payable to third parties, such as home office or visa application fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

  • Interpreters fees on average range between at £48 per hour to £95 per hour plus VAT (at the applicable rate). This kind of application will normally require between 2 to 2.5 hours with an interpreter, depending on the complexity of your case. If there are any Interpreter fees, we will advise you of these on instruction. Please note that you do not need to use an interpreter of our firms choosing. You can bring a friend to come and help interpret for you at our office.
  • Independent expert reports e.g. medical experts. These are not required in many cases: we will let you know as soon as possible if we consider an expert report is necessary.
  • If there is an interview and we do attend with you, there will be additional disbursements in respect of our attendance at the Home Office, mileage/travel expenses. We charge £350 for attendance, £96 per hour for travelling and 54p per mile (plus any parking costs). These figures include VAT.

The fees quoted above are for the services provided by our professionals and do not include the following:

  • Any Home Office fees for making the application. (Please click on the link to view the current Home Office fees). You will pay this to the Home Office directly as part of the application process.
  • Where the Home Office refuse your application, advice and assistance in relation to any appeal.
  • Any Court fees. For example, most appeals which are dealt with in the First-tier Tribunal (Immigration and Asylum Chamber) require a fee to be paid before an appeal is processed. If an appeal is required then it will cost, for each person appealing, either: £80 for an appeal to be determined on the papers provided; or £140 for an appeal to be determined at an oral hearing
  • Any Barrister fees. A Barrister can be instructed upon request. Barrister fees would need to be negotiated on an individual basis
  • Any Interpreter fees. We will advise you of these on instruction. Please note that you do not need to use an interpreter of our firms choosing. You can bring a friend to come and help interpret for you.

Please be aware that in cases where it is apparent at the outset or becomes apparent after we have initiated work on your Immigration matter, that we will have to do more work than normally due to complexities or for any other reason, we reserve the right to charge a higher fee than quoted above.

Our professionals will always endeavour to advise you in writing of the reason why we feel more work needs to be done and the amount of the additional fees we propose to charge for the work.

Alternative Option: Hourly rates for Immigration services

You may choose to instruct us to charge fees on an hourly basis. Below is a worked example of how we would charge on an hourly basis.

The number of hours spent on your matter will depend upon the particular circumstances and complexity of your case and therefore an initial estimate will be given.

Our standard Hourly rate is: £ 217.00 plus VAT (at the applicable rate).

The exact number of hours it will take depends on the circumstances in your case such as:

  • The amount of supporting evidence that we need to consider
  • Which language(s) you speak
  • Whether you are applying with other dependants
  • If you are able to provide sufficient documentary evidence at our initial meeting and can clearly demonstrate that you meet the applicable Immigration Rules, it is likely that less time will be spent on the matter.

Please note that our hourly charging rates do not include any disbursements for example:

  • Any Home Office or British High Commission visa fees for making the application. You will pay this directly as part of the application process.
  • Where the Home Office refuse your application, advice and assistance in relation to any appeal.
  • Independent expert reports e.g. medical experts. These are not required in many cases: we will let you know as soon as possible if we consider an expert report is necessary.
  • If there is an interview and we do attend with you, there will be additional disbursements in respect of our mileage/travel expenses.

Worked example of Hourly Rate Costs

Hourly Rate: Application for further leave to remain- marriage

Hourly rate: £ 217.00 plus VAT (at the applicable rate).

On average, this type of work takes between 5 - 6 hours to complete. This means that on average costs are between £1085 plus VAT (at the applicable rate) and £1302 plus VAT (at the applicable rate).

The exact number of hours it will take depends on the circumstances in your case. Such as:

  • The amount of supporting evidence that we need to consider
  • Which language(s) you speak
  • Whether you are applying with other dependants

If you are able to provide sufficient evidence at our first meeting and clearly meet the applicable Immigration Rules, the cost is likely to be at the lower end of this range.

What services are included

The work covered includes the following:

  • Discussing your circumstances in detail and confirming whether this is the most appropriate application for you to make and what other options may be available to you;
  • Giving you advice about the requirements of the Immigration Rules and whether you meet the criteria;
  • If you do not fulfil certain criteria, whether this can be overcome and how, which on average takes 1 hour;
  • Considering the supporting evidence you have provided, which we anticipate will take 1-2 hours
  • Where necessary, helping you obtain further evidence (such as medical records and bank statements), including taking statements of any witnesses;
  • Preparing your application and submitting it on your behalf, which we anticipate will take 1 hour.
  • Attendance at a Home Office interview: if the Home Office ask you to attend an interview, we will give you clear advice (and discuss the possibility of us attending with you) at the appropriate time. This could be between 2-3 hours of work.
  • Giving you advice about the outcome of the application and any further steps you need to take.

All of the above Immigration services include:

  • Taking your initial instructions and providing advice;
  • Considering and reviewing documents;
  • Attending to the client;
  • Preparing and submitting the application;
  • Advising the client on timelines;
  • Updating clients on the progress of their matter;
  • Telephone calls between us and the client;
  • Telephone calls between us and third parties;
  • Correspondence between us and the client including email and letters;
  • Correspondence between us and third parties including email and letters;
  • Informing the client on outcome of their application.

*the number of hours depends on the number of documents, whether they need to be translated, whether anything is missing and how long it will take to obtain the missing documents. Disbursements (not included in costs set out above).

How long will my application take?

We cannot guarantee how long the Home Office will take to process your application. Read the current processing times.

We will normally be able to submit this type of application within 1-2 weeks of you instructing us and subject to you providing us with all the supporting documents and information. However, we will let you know at the earliest opportunity if it is likely to take longer than this. We will update you on the progress of your application.

Please note the anticipated hourly chargeable rates and fixed fees are an estimate based on the facts above. All applications are likely to vary and of course, we can give you a more accurate estimate once we have more information about your specific case.

Abid is the head of our team in the Oldham Office and has over 15 years of experience in private client work, specialising in immigration. Abid has been working in this area since he qualified and has helped thousands of families and individuals.
